What is Stamp Duty (Transfer Duty) on Australian Investment Property?

Stamp duty (officially called transfer duty in most Australian states) is a state government tax levied on the purchase and transfer of real estate, calculated on a sliding scale based on the property’s contract price or market value and the state or territory in which it sits. Unlike first-home buyers—who may receive concessions—property investors pay full stamp duty upfront at settlement (except in the ACT, where stamp duty is tax-deductible for leasehold investment properties). Stamp duty forms part of your property’s capital cost base, reducing Capital Gains Tax when you eventually sell.

How to Read Stamp Duty (Transfer Duty) in Australian Property

Reading / TierMarket InterpretationWhat It Means for Property Investors
Upfront Tax Treatment (NSW, VIC, QLD, WA, SA, TAS, NT)Capitalised into CGT cost baseNot immediately deductible against annual rent, but reduces future CGT on sale
Upfront Tax Treatment (ACT)99-year Crown Lease ruleGenerally deductible for income-producing ACT properties (confirm with tax adviser)

How state stamp duty differences affect your purchase budget

Because Victoria levies higher transfer duty than Queensland or New South Wales on a $650,000–$800,000 purchase, the exact same $160,000 equity release can support a different maximum contract price depending on which state you buy in. We factor exact state transfer duty and land-tax rules into your Strategy Session brief.
